Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Gamepad Tester ("we," "us," "our," or the "Company"), governing your access to and use of the website gamepadtester.co.uk and all associated subdomains, tools, content, and services (collectively, the "Site" or "Services").

By accessing, browsing, or using any part of this Site, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Site on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Gamepad Tester provides a suite of free, browser-based hardware testing tools and informational content for gamers, hardware enthusiasts, developers, and the general public. Our Services include, but are not limited to:

All tools operate entirely within your browser. No controller inputs, key presses, mouse data, or click counts are transmitted to our servers. We reserve the right to add, modify, suspend, or discontinue any tool or feature at any time with or without notice.

Eligibility & Access

Age Requirements

Our Site is available to users of all ages. However, users under the age of 13 should only use the Site with parental or guardian supervision. By using the Site, you represent that you are either 13 years of age or older, or that you are using the Site under appropriate parental supervision. We do not knowingly collect personal information from children under 13 years of age.

Geographic Access

We make no representations that the Site is appropriate or available for use in all countries. If you access the Site from outside the United States, you do so at your own risk and are responsible for compliance with any local laws that may apply. We reserve the right to restrict access from any jurisdiction at our sole discretion.

Technical Requirements

Use of our tools requires a modern web browser with JavaScript enabled. For the best experience and full feature support, we recommend Google Chrome or Microsoft Edge. Our gamepad tools use the browser Gamepad API, which requires a connected controller and a browser press-event to activate. We are not responsible for any incompatibility between our tools and your hardware, browser, or operating system.

No Account Required

You do not need to create an account to use any of our tools. We do not currently offer user accounts. All tool results, session data, and test history exist only in your browser's local memory for the duration of your session and are not stored or transmitted.

Permitted & Prohibited Use

Your use of the Site is subject to the following usage rules. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes in accordance with these Terms.

Intellectual Property

Our Content

All content on the Site — including but not limited to the tool interfaces, source code, written articles and guides, graphics, logos, brand assets, design elements, the "Gamepad Tester" name and mark, and all other original material — is owned by or licensed to Gamepad Tester and is protected by United States and international copyright, trademark, and other intellectual property laws.

Limited Licence to Users

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use our Site for your own personal, non-commercial purposes. This licence does not include the right to:

• Reproduce, distribute, or publicly display any content from the Site without express written permission
• Create derivative works based on our content or tools
• Use any content for commercial purposes without prior written consent
• Remove or alter any copyright, trademark, or other proprietary notices on the Site

Open-Source Components

Some components of our tools may use open-source libraries or frameworks (such as Google Fonts or the W3C Gamepad API specification). These components are governed by their respective open-source licences. Nothing in these Terms limits the rights granted under those open-source licences.

Trademark

"Gamepad Tester" and associated logos are trademarks or service marks of Gamepad Tester. You may not use these marks in connection with any product or service in a manner that is likely to cause confusion, or in any manner that disparages or discredits Gamepad Tester, without our prior written consent.

Copyright Infringement

User Content

Content You Submit

If you submit any content to our Site — including comments, feedback, bug reports, feature suggestions, or any other communications — you grant Gamepad Tester a non-exclusive, worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish, and distribute that content in any form for the purpose of operating, improving, and promoting our services.

Content Standards

Any content you submit must not:

• Infringe the intellectual property rights of any third party
• Contain viruses, malware, or any other harmful code

Tool Results

The results produced by our testing tools (including but not limited to controller input readings, CPS scores, drift values, and rollover counts) are provided for informational and diagnostic purposes only. These results are dependent on your browser's implementation of the relevant web APIs, your hardware's drivers and firmware, and many other factors outside our control.

Hardware Disclaimer

Gamepad Tester is not responsible for any damage to hardware that may occur as a result of following advice, guides, or repair instructions on our Site. Hardware repair involves inherent risks. Always consult a qualified technician for repairs that you are not confident in performing yourself.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GAMEPAD TESTER, ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH:

• Unauthorised access to or alteration of your transmissions or data

IN NO EVENT SHALL GAMEPAD TESTER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU HAVE PAID TO GAMEPAD TESTER IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100), WHICHEVER IS GREATER.

Our tools use standard browser APIs including the W3C Gamepad API, the Vibration API, and the Web Keyboard API. As our tools do not require an account, "termination of access" may take the form of IP-level blocking or other technical measures. We have no obligation to provide access to our Site to any individual or entity.

Governing Law & Dispute Resolution

Governing Law

These Terms and any disputes arising out of or relating to them or your use of the Site shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions.

Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us in good faith to attempt to resolve the dispute informally. Please send a written description of your dispute to gamepadtester.co@gmail.com. We will endeavour to respond within 30 days and work with you to resolve the matter informally where possible.

Jurisdiction

If informal resolution is unsuccessful, you agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in the State of New York, United States. You consent to the personal jurisdiction of those courts and waive any objection to such jurisdiction or venue.

Waiver of Class Action

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF FOR ANY REASON A CLAIM PROCEEDS IN COURT RATHER THAN ARBITRATION, YOU WAIVE ANY RIGHT TO A JURY TRIAL.

Users Outside the United States

If you are accessing the Site from outside the United States, you do so at your own risk and are responsible for compliance with your local laws. These Terms and any dispute resolution shall still be governed by New York law as described above.
