Gamepad Tester ("we," "us," or "our") operates the website gamepadtester.co.uk and its associated subdomains (collectively, the "Site"). How to Submit a DMCA Takedown Notice

If you are a copyright owner or an authorised representative and you believe that content on our Site infringes your copyright, you may submit a written DMCA takedown notice to our Designated Copyright Agent. Your notice must include all of the following elements to be valid under 17 U.S.C. § 512(c)(3):

Your physical or electronic signature. The notice must be signed by the copyright owner or a person authorised to act on their behalf.

Identification of the copyrighted work. A clear description of the copyrighted work you claim has been infringed. If multiple works are covered by a single notice, a representative list is sufficient.

Identification of the infringing material. The specific URL or location on our Site where the allegedly infringing material appears, with sufficient detail to allow us to locate it.

Your contact information. Your full name, mailing address, telephone number, and email address so that we can contact you regarding your claim.

Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.

Accuracy statement. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

⚠️ Misrepresentation Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for any damages, including costs and legal fees, incurred by the alleged infringer, the copyright owner, or the service provider as a result of the misrepresentation.

Our Response Process

Upon receipt of a complete and valid DMCA takedown notice, we will follow this process:

Receipt & Initial Review
We acknowledge receipt of your notice and review it to determine whether it contains all required elements under 17 U.S.C. § 512(c)(3). Incomplete notices will be returned with guidance on what information is missing.
Within 1–2 business days

Content Investigation
We locate and review the identified content on our Site. We assess whether the material appears to infringe the claimed copyright and whether any defences such as fair use may apply.
Within 2–3 business days

Takedown or Dispute
If the notice is valid and the content appears infringing, we will remove or disable access to the material promptly. If the content is our original work or appears to be used lawfully, we will respond explaining our position.
Within 5 business days of valid notice

Notification to Content Poster
Where applicable, we will notify the person who posted the affected content that it has been removed or disabled due to a DMCA notice, and provide information about the counter-notice process.
At time of takedown

Counter-Notice Period
The affected party has 10 to 14 business days to submit a counter-notice. If a valid counter-notice is received and you do not notify us of a court action within 10–14 business days, we may restore the content.

Counter-Notice Procedure

If you believe that content you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notice to our Designated Copyright Agent. A valid counter-notice under 17 U.S.C. § 512(g)(3) must include:

Your physical or electronic signature.

Identification of the removed material and the location at which the material appeared before it was removed or access to it was disabled, with enough detail for us to locate it.

A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

Your full name, address, and telephone number.

Consent to federal court jurisdiction. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside the United States, that you consent to jurisdiction in any federal judicial district where Gamepad Tester may be found.

Consent to service of process from the person who filed the original DMCA notice, or that person's agent.

Upon receipt of a valid counter-notice, we will forward it to the original complainant. If the complainant does not notify us within 10 to 14 business days that they have filed a legal action seeking a court order restraining the allegedly infringing activity, we may, at our sole discretion, restore the removed or disabled content.

ℹ️ Submitting a counter-notice is a legal step. If you are unsure whether removed content was legally yours to post, we strongly recommend consulting a qualified attorney before submitting a counter-notice.

Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Gamepad Tester maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts and access privileges of users who are deemed to be repeat infringers.

A "repeat infringer" is a user who has been the subject of multiple valid DMCA complaints. We reserve the right to terminate access for any user we deem, in our sole discretion, to have repeatedly infringed the copyrights of others, regardless of whether any formal takedown notice has been received.

We also reserve the right to terminate access for users who, in our judgement, misuse the DMCA process — for example by submitting repeated false or fraudulent takedown notices — without prior warning.

Fair Use & Limitations

Not all uses of copyrighted material constitute infringement. The doctrine of fair use (17 U.S.C. § 107) permits limited use of copyrighted material without the copyright owner's permission in certain circumstances, including commentary, criticism, news reporting, teaching, scholarship, and research.

Factors courts consider in determining fair use include:

  • The purpose and character of the use, including whether it is commercial or for non-profit educational purposes
  • The nature of the copyrighted work
  • The amount and substantiality of the portion used in relation to the copyrighted work as a whole
  • The effect of the use upon the potential market for or value of the copyrighted work

Before submitting a DMCA notice, we encourage copyright holders to consider whether the use of their work on our Site may constitute fair use. We take fair use considerations into account when evaluating all claims.
